Arion Pedigrees Ltd ("Arion") provides access to the databases ("Databases") it manages through the Arion website ("The Website").  The conditions upon which Users can access this data ar outlined herein.

1.         THE SERVICES

The Website provides a structured interface to the information contained on the Databases.  Access to this information is provided to Users solely on the Terms and Conditions outlined herein. 

Arion will use its best endeavours to ensure Users receive uninterrupted access to the Website. Arion however reserve the right to alter or remove the service as it deems fit.

By using any of the Services on this website, whether they be free or chargeable, and either logged in or anonymously, you agree to the Terms and Conditions detailed herein.

2.         USER CONDITIONS

Arion grants you a non-exclusive and non-transferable licence to access the Service and to use the Information subject to these Terms.

Copyright and other intellectual property rights protect the Service and the Information. The Information may not be reproduced other than for your own personal or internal business purposes.

The information may not be used for any commercial exploitation or made available on a network or otherwise reproduced, transmitted, broadcast or displayed in public without the prior written permission of Arion.

The information may not be used to produce a catalogue for the sale of thoroughbreds at any public or private auction without the prior written permission of Arion. Where Arion becomes aware of a breach to this restriction, Arion shall be entitled to charge for the services supplied at Private Pedigree rates

The information may not be used to produce form guide of any description.

3.         WARRANTIES AND LIABILITY

Arion warrants that it will use all reasonable skill and care in producing the Service and making it available for access but you acknowledge that access to it may not be uninterrupted or error free and could be subject to delays in particular, but not only, as a result of the Service being provided by the public Internet.

Arion makes no other representations or warranties, express or implied, regarding the Service and the Information and all representations, warranties, terms and conditions whether express or implied by statute, common law or otherwise are excluded to the fullest extent permitted by law. Arion accepts no responsibility or liability for access to, or the material on, any service, which is linked from or to the Service.

In no event shall Arion be liable to you for any indirect, special, incidental, punitive, or consequential losses or damages (including third party claims, loss of profits, revenue or goodwill) suffered by you or any third party howsoever caused whether by breach of contract, negligence or otherwise (including any such loss or damage suffered by you as a result of an action brought by a third party) arising in relation to the Service (including any errors, inaccuracies or omissions in the Information or any faults, interruptions or delays in connection with the Service) Arion accepts no liability for or any transaction made in reliance on the Information or in connection with the Service.

Arion shall not be liable for any failure, interruption or delay of the Service due to something beyond its reasonable control such as technical failure, lightning, flood or exceptionally severe weather, fire or explosion, civil disorder, war, or military operations, natural or local emergency, anything done by government or other competent authority or industrial disputes to any kind. (Including those involving its employees.)

You must indemnify Arion against loss, damage or expense incurred by Arion arising out of your misuse of the Service or Information.

4. REFUND POLICY

You acknowledge that it is your responsibility to select the Product and Horse combination that mets your requirements. Due to the nature of the information being sold, we unfortunately can not offer a refund other than where you can clearly demonstrate that the wrong Product/Horse combination was inadvertently purchased.
